Page 4 of 5 Article 7: Force Majeure 7.1 In addition to what is understood under Aruban Law as Force Majeure also applies as such, any form of strike or interruption of the work, as well as a situation in which implementation of the activities brings forth unacceptable risks for the staff of MF. Article 8: Guarantee 8.1 When performing cleaning and inspection work, MF is committed to work to the best of its understanding, ability and skill. The client can in no case claim against MF if the client has failed to fulfill his/her obligations towards MF. Article 9: Liability 9.1 MF accepts absolutely no liability regarding the client and/or third parties for damage suffered by the client and/or third party or damage that they will suffer because of execution of the activities by MF and/or its subordinates and/or helpers, the client will protect MF at this point against all possible claims/revendications of third parties. 9.2 In all the cases any possible liability on the side of MF is limited to the amount invoiced by MF for that concerning workday, with a maximum total indemnity of Afl. 2,000.00. Article 10: Security 10.1 MF is always entitled to ask the client payment in advance or sufficient security to obtain payment. Article 11: Dissolution 11. If the client is in default for any matter concerning his/her obligations or, in the event of a bankruptcy or, suspension of payment of the client, MF has the right to dissolve the contract where these conditions apply to completely or in part, without judicial intervention and without prejudice to its right to compensation. |
