Page 1 of 5 General Conditions of The limited company More Flow Services International N.V., established and with domicile in Aruba hereinafter referred to as “MF”. Article 1: Applicability 1.1 These general conditions apply to all the agreements closed between MF and a natural or legal person (“the client”). 1.2 The following conditions can only lawfully be waived unless and so far the client and MF explicitly have agreed upon this in advance and in writing. Article 2: Implementation of the Agreements 2.1 All quotations or offers, by whatever name or in any form whatsoever, are non-committal. If a quotation includes a non-committal offer and this is accepted, MF has the right to revoke the order within five workdays after receiving the acceptance. 2.2 The offers presented by MF are based upon information, drawings etc. provided by the client, of which MF must assume that they are correct. 2.3 An offer granted by the client to MF is only binding for MF if this has been authorized by the Management of MF, or when warrantees assigned by MF have authorized the assignment in writing – who is supposed subject to a notification without delay of the client, to display correctly the offer confirmation, or has to do so as soon as MF has started with the implementation of the offer. Article 3: General liabilities of the client 3.1 The client ensures that MF shall have on time disposition of all the information necessary, a complete list of the details related to the implementation of the agreement and a (topographical) map of all the existing pipelines. 3.2 MF shall not be liable for any damage and/or consequences or damage to a third party as a result of the fact that the client cannot provide MF with a (topographical) map displaying the real situation, or in case that the map does not reflect a correct image of the real situation. |
